GOVERNMENT, AGENCY OR SUBDIVISION THEREOF.
You agree to indemnify, defend and hold harmless Healthible, its subsidiaries, and affiliates,
and their respective officers, directors, employees and agents, from and against any and all
claims, actions, liabilities, damages, losses, costs, expenses and fees (including attorneys’ fees)
arising from or related to your use of our website and services. If you are using our website or
services on behalf of a business, that business accepts these Terms of Service.
We may from time-to-time modify these terms or add terms that apply to our website and
services. We may also add or remove any functionalities or features, and may suspend or stop
a service altogether. You may elect to stop our services or we may stop providing services to
you at any time. We will post notices or notify you of modifications to our service. Changes will
not apply retroactively. If you do not agree to the modified terms, you may elect not to opt-in to

affect its original intent, and the remaining provisions of these terms will remain in force. Any
disputes arising out of or relating to these Terms are governed by the laws of the State of
Hawaii. You hereby consent to the exclusive jurisdiction of the courts of Hawaii for any legal
disputes.
